SMS CONSENT AND VERBAL OPT-IN PROCEDURE

Purpose of Messaging: The firm sends transactional text messages only to prospective or existing clients who expressly request information and provide verbal consent during an inbound telephone call. Messages may include consultation scheduling information, secure payment instructions requested by the caller, appointment confirmations, appointment reminders, rescheduling notices, Google Meet information, and limited follow-up directly related to the legal inquiry initiated by the recipient.

Receptionist: “Would you like to receive text messages from Fajardo, Gil, Velarde & Associates regarding the legal consultation you requested, including scheduling information, payment instructions, appointment confirmations, reminders and requested follow-up? Message frequency varies, generally up to four messages per consultation request. Message and data rates may apply. You may reply STOP at any time to opt out or HELP for assistance. Consent is optional and is not a condition of purchasing legal services. Do you agree to receive these messages?” Caller: “Yes, I agree.” Receptionist: “Thank you. Your consent has been recorded. You will receive a confirmation message from Fajardo, Gil, Velarde & Associates. You may reply STOP at any time to stop receiving messages.”

GUION DE CONSENTIMIENTO VERBAL — ESPAÑOL 

Recepcionista: “¿Desea recibir mensajes de texto de Fajardo, Gil, Velarde & Asociados relacionados con la consulta legal que solicitó, incluyendo información para agendar, instrucciones de pago, confirmaciones de cita, recordatorios y seguimiento solicitado? La frecuencia de los mensajes puede variar y normalmente será de hasta cuatro mensajes por solicitud de consulta. Pueden aplicarse tarifas de mensajes y datos. Puede responder STOP en cualquier momento para dejar de recibir mensajes o HELP para solicitar ayuda. CONSENT RECORDKEEPING

When the recipient provides affirmative consent, the firm records: - The recipient’s telephone number. - The date and time of consent. - The associated call identifier. - The language used. - The recipient’s affirmative response. - The purpose for which messaging was authorized. If the recipient declines or does not provide an affirmative response, no text message is sent. Recipients may revoke consent at any time by replying STOP. Recipients may request assistance by replying HELP. The firm does not purchase contact lists, send unsolicited messages, or sell or share mobile opt-in information for marketing purposes.

GOVERNING LAW AND JURISDICTION. To the extent permitted by applicable law, any dispute arising out of or relating to the interpretation, validity, performance, enforcement, or termination of this SMS consent or the messaging program’s Terms and Conditions shall be governed by the applicable laws of the United Mexican States and the State of Quintana Roo. The user and Fajardo, Gil, Velarde & Associates expressly submit to the jurisdiction of the competent courts located in Cancún, Municipality of Benito Juárez, Quintana Roo, Mexico, and waive any other venue or jurisdiction that may otherwise apply based on their present or future domicile or for any other reason. This provision shall not limit any non-waivable rights available to the user under applicable consumer-protection laws or other mandatory legal provisions.
